Freight Ninja,

What experience have you had with freight claims? The carriers never seem to want to pay. Often times the consignee signs the bill free and clear and then I'm SOL and just get the typical denial letter. Other times my receiver will note dame on the bill of lading and its still a fight. I read some fine print where it says the carriers pay per pound. Moreover, the price per pound varies depending on the class of freight. Why can't the carriers just pay what the actual damage is? I have no problem with a carrier representative coming out and inspecting.

Each carrier does a release value based on weight and the class determined by the NMFC. I suggest that consignees inspect all freight thoroughly before signing for it, no matter how rushed the driver says he is. If the freight is damaged, DO NOT accept it. Refuse it and it will return to the shipper at no additional cost. The shipper can then inspect the freight for damages.

Freight forwarders are able to shop the carrier for who offers the most insurance, and most can also offer you additional insurance. Freight forwarders also spend the time negotiating for you on the claim.

You file a claim against your OWN insurer. You can report a claim to the shipper, and/or the trucking company, but THEIR insurer does not have to accept a report filed by a third party.If you want to collect damages from a third party insurer, the first step is to report it to the trucking company AND the shipper. Request a response in writing. If they will not file the claim with their insurer, or if they deny the claim, you can then file with YOUR insurer, or sue them in court.
